Protected Health Information
AAHRPP is not a covered entity subject to the Health Insurance Portability and Accountability Act or its implementing regulations (“HIPAA”). In addition, because Organizations are required to de-identify all information provided to AAHRPP, and are not permitted to provide AAHRPP with any information that is not de-identified, AAHRPP is also not a business associate of any Organization that is a covered entity. To the extent that Site Visitors or other AAHRPP Representatives might inadvertently come into contact with an Organization’s protected health information (“PHI”), AAHRPP will use good faith efforts to cause them to (1) comply with HIPAA and the Organization’s internal policies and (2) not record or disclose such PHI.
